By activating or otherwise using the REMAX Canada PerksConnect program (the “Program” or “REMAX Canada PerksConnect”), you are agreeing to the following terms and conditions (the “Terms and Conditions”). You understand that Augeo Affinity Marketing, Inc., and its subsidiaries and vendors and partners (collectively, “Augeo”) make available online information and services to members of the Program (the “Members”). By activating or otherwise using the Program, you are indicating and certifying that you are at least 18 years old, are NOT a resident of Quebec and you agree to be bound by these Terms and Conditions. You acknowledge that these Terms and Conditions may be modified at any time. Any changes will appear on this page. It is your responsibility to refer to these Terms and Conditions prior to using, and whenever you use, the Program. You will be deemed to have accepted any change to these Terms and Conditions if you register, use or continue to use the Program after any changes thereto have been posted here.

The Program is a discount program that provides Members with savings and benefits offered by participating merchant locations in Canada and/or online, however, the goods, services and benefits offered in the Program are NOT available to and are not being marketed to Quebec residents.

1. Eligibility

Members must be Canadian residents, other than from Quebec, and at least 18 years of age to participate, unless a specific program, campaign, client, or merchant partner allows for participation outside of Canada or the participation of Members under the age of 18.

2. Registering for REMAX Canada PerksConnect

Registration for the Program is required to receive in-store discounts from participating merchants. In order to access the online benefits and features, you may be required to create an account. When you create an account, you must provide accurate and complete information (including but not limited to: card number, group code, username, password and zip code) and advise of any changes by updating your online profile or contacting our Customer Service team. REMAX Canada PerksConnect will use this information to create your account, register your REMAX Canada PerksConnect and, where applicable, provide you with new discount information pertaining to the Program.

Those who complete the registration form are responsible for submitting correct personal information during the time of registration. Members who do not wish to participate in this discount program are not required to submit their address information in order to become a registered member. Any future changes required by a Member must be submitted and updated by the Member via his or her account or profile. Any change made by a registered Member is the sole responsibility of the Member.

When you register online, you will be asked to create a password to view your account. You may not select a password that violates anyone’s rights or one that, in Augeo’s sole discretion, is considered vulgar, profane, offensive, improper, or inappropriate. If you do so, Augeo may modify or delete it or cancel your account and your participation in the Program.

Augeo does not permit the sharing of your Program account information, including your account number, password, or any applicable discounts or discount codes with anyone. If Augeo reasonably believes that any of your Program materials are being used, by you, or by any other Member, in any of these ways, Augeo reserves the right to end or cancel your participation in the Program and/or your status as a Member. If you believe someone has used any of your Program materials without your authorization, please contact REMAX Canada PerksConnect Customer Service.

3. Using REMAX Canada PerksConnect

Your REMAX Canada PerksConnect account provides you access to certain savings, benefits and services. You must register for the Program to access the complete savings, benefits and services, but you can receive discounts at participating merchants without registering. Visit: remax.ca.perksconnection.com to register for the Program. Your REMAX Canada PerksConnect account is nontransferable and may only be used by the person whose name is associated with the account and the card number.

Use of your REMAX Canada PerksConnect benefits at a participating merchant’s location:
You must present your REMAX Canada PerksConnect offer before you make a purchase at a participating merchant. A merchant has the right to deny a discount if you do not present REMAX Canada PerksConnect offer before payment.

Use of your REMAX Canada PerksConnect benefits online:
You can access the benefits of the Program online by visiting: remax.ca.perksconnection.com and signing in. Certain featured offers, online shopping benefits and other benefits will require registration. Other benefits may be available to any visitor. REMAX Canada PerksConnect membership may not be required, in every instance, to take advantage of the online services. However, many services may be offered only to Members. Any visitor to REMAX Canada PerksConnect is required to abide by the terms and conditions hereof.

Any use of REMAX Canada PerksConnect or the associated Member benefits and discounts in a manner that violates the rules or regulations of any participating merchant or online partner is prohibited by this Agreement and is grounds for termination of your right to use or participate in the Program, and will result in a forfeiture of any savings, benefits, and services opportunities. Augeo reserves the right to cancel your membership and all your Member rights immediately in the event of such a violation and to terminate, fully and finally, your participation in the Program.

4. Tracking Member Activity

Augeo uses various tracking technologies in conjunction with third party advertising affiliates. In most cases, the tracking used may require a cookie to be placed onto the Member’s computer. This is required in order to fully track the Member activity and to assure that the Member is credited for any completed application for a specified product or service. Members must have their browser set to enable cookies in order to participate in the Program.

Augeo reserves the right to use your information for data gathering purposes. All such information will be anonymized or de-identified and we will not have access to any of your personally identifiable information. We cannot identify particular devices. You may opt out from using the Site (as defined herein and below) if you choose to do so.

5. Expiration and Cancellation

Your REMAX Canada PerksConnect membership may be subject to expiration and cancellation at the discretion of Augeo following any breach of these Terms and Conditions by a Member, termination of a sponsor, or termination of a particular program. A Member will no longer be entitled to any discounts, benefits, or rewards following the expiration or cancellation of a REMAX Canada PerksConnect membership or account. Discounts, benefits, and rewards not redeemed by the date that a REMAX Canada PerksConnect is cancelled shall be forfeited and shall be null and void.

6. The Web Site

The REMAX Canada PerksConnect web site (the “Site”) offers the most up-to-date information on savings and partner benefits offered by participating merchants. Augeo is not responsible for third parties’ restrictions or changes to their offers. As a Member, you will have to log in to access certain sections of the Site, using your username and password.

When changing information on your account, you agree to provide accurate and complete information.

You can search for savings and participating merchants online. When you wish to purchase goods or services online at the Site or at a participating merchant’s web site, you may be required to enter your REMAX Canada PerksConnect account number or a promo code in order to receive the discount. Some merchants and discounts may not be available in your community or your province. Every effort has been made to make sure that all information is accurate within the REMAX Canada PerksConnect Site, but there is no guarantee and/or warranty as to the accuracy of any information found on or within the Site. Participating merchants’ contact information has been provided for Members. This information is believed to be accurate during the time of publishing, but Augeo cannot and will not be held liable for any inaccuracies. You should contact the participating merchant in advance to confirm it offers the discount. Even though Augeo makes efforts to keep the listing of participating merchants and savings up to date, Augeo is not responsible for incorrect or incomplete information regarding the participating merchants or their discounts. You may submit corrections for participating merchants or discounts in an email to Customer Service - REMAX Canada PerksConnect.

The Site may be used to contact the Members Services department. For questions, concerns or suggestions e-mail REMAX Canada PerksConnect at the email address(es) listed above. An agent will respond to your email promptly and attempt to do so within 72 hours.

At any time, the Site may contain links to other web sites throughout the Internet. Any links to such sites are operated and/or owned by third parties. Augeo and Augeo’s clients, merchant partners, and/or customers may not be held liable for any inaccuracies of these links, availability or unavailability of information, and/or the content or information that may be found within third party web site(s). During times of maintenance or during unforeseen occurrences or outages, the Site, or websites of Augeo and/or merchants who participate in the discount program may be temporarily unavailable. Down times may vary and may be the result of various circumstances, many of which may are beyond the control, and are not the responsibility, of Augeo. Nevertheless, during such circumstances, Augeo will actively work on resolving the problem, but Augeo and Augeo’s clients and/or customers cannot be held responsible for any for any inconveniences or loss of discounts, benefits, or rewards of cardholders or Program participants.

Augeo is not associated with the participating merchants or any other U.S. company or organization (private, public, or governmental) that may be listed throughout the Site, except for affiliate programs that advertise their products or services throughout as being offered by or through Augeo, specifically, utilizing either banner advertisements or direct text links.

Augeo disclaims any form of relationship or ownership to any of the logos or trademarks of any merchants listed throughout the Site.

No information or content found within the Site may be copied or used, for any reason, without the prior written consent of Augeo.

You understand and agree that the use of the Site is undertaken at your own risk. Augeo shall have no liability for any interruption in service, or for any inaccuracies, or lack of reliability with respect to the Site, nor does Augeo warrant against the occurrence or results of such possible incidents that may cause damage(s) and/or inconvenience(s) to the Member. Augeo will not be held liable for any possible consequential, special, unforeseeable, or indirect damages that may result from the use, or inability to use, the Site.

Augeo may suspend, change, or stop the service or any aspect of the Site at any time during operation, including but not limited to merchant information, databases or other content without any prior notification or liability.

7. Discount Program

See: remax.ca.perksconnection.com for an up-to-date listing of participating merchants. When making a purchase at a participating merchant, Members must show their REMAX Canada PerksConnect offer to calculate the discount, reward or other benefit they will receive. The participating merchant will immediately take the discount off of the purchase price at the point-of-sale. Periodically, promotions, incentives or other benefits associated with REMAX Canada PerksConnect may be offered. These promotions will be communicated on the Site and may be communicated directly to customers who have registered and agreed to receive program announcements.

Augeo reserves the right to add, remove, and/or update any service provided within the Program. Augeo may contact Members about any additional services and/or adjustments to this discount program. However, Augeo has no obligation, under any circumstance, to contact Members about changes made to the program.

8. Merchants, Discounts and Merchant Products

Augeo and REMAX Canada PerksConnect merchant partners are independent contractors. Augeo is not responsible for the discounts, rewards or bonus services offered by any merchant partners. Augeo is not responsible for the delivery of any discount, conduct of the merchant, or changes by the merchant of its discount for any reason. Merchants may not discount all products offered for sale and stated discounts may vary at the point of purchase.

Augeo makes no warranty, expressed or implied, about any goods and services purchased from a merchant. Each Member will look solely to the merchant for any and all discounts, returns, performance and nonperformance issues, warranty service, and/or any damages suffered by a Member or any third party arising out of the sale or use of goods or services provided by any merchant. If you have a dispute with a participating merchant, please report the dispute to Augeo by contacting REMAX Canada PerksConnect Customer Service. However, you must resolve the dispute directly with the participating merchant. Reports must be submitted and mailed to Augeo at the REMAX Canada PerksConnect Customer Service address(es) provided above, in written form with the following information: merchant name, merchant address, date of purchase, discount denied, and purchase information.

AUGEO IS NOT LIABLE IN ANY MANNER FOR ANY PRODUCTS OR SERVICES PROVIDED BY OR THROUGH ANY MERCHANT WHO PARTICIPATES IN THIS DISCOUNT PROGRAM OR FOR ANY ERROR, OMISSION OR INACCURACY IN ADVERTISING MATERIAL OR FOR ANY LIABILITY RESULTING DIRECTLY OR INDIRECTLY FROM A PRODUCT OR SERVICE PROVIDED BY ANY MERCHANT OR OTHER THIRD PARTY IN CONNECTION WITH THIS DISCOUNT PROGRAM.

On the Site, Augeo provides links to selected merchants for your convenience only. Augeo is not responsible for the contents of any off-Site pages referenced. Referencing off-Site pages or any commercial product or service does not constitute or imply its endorsement or recommendation by Augeo. Neither Augeo nor any of its employees makes any warranty, express or implied, or assumes any legal liability or responsibility for the accuracy, completeness or usefulness of any information from links or documents available on the Site.

9. E-mail Policy and Communication Preferences

Members have the option to receive REMAX Canada PerksConnect e-mail and/or mobile phone updates when they register for their REMAX Canada PerksConnect membership online. REMAX Canada PerksConnect uses these email and mobile phone updates to provide additional savings, special offers, site upgrades, new features, events, promotions and more. You have the option to e-mail us to opt out from receiving these e-mails using the link at the bottom of any promotional e-mail you may receive. You also have the option to email REMAX Canada PerksConnect Customer Service to opt out of receiving the mobile phone messages. Members can also update these preferences by logging into their account on: remax.ca.perksconnection.com

Augeo reserves the right to e-mail you with information essential to your participation in the Program (for example, information on lost passwords, REMAX Canada PerksConnect shipment information and REMAX Canada PerksConnect expiration/renewal). You will not have the option to opt-out of e-mails of this nature.

10. Bulk Enrollment

Augeo permits certain merchants, associations, media sources and other third-party organizations (“Bulk Partners”) to distribute REMAX Canada PerksConnect credentials or the opportunity to become members of the Program to the Bulk Partner’s customer base (a “Bulk Enrollment”). In connection with a Bulk Enrollment, Augeo collects from the Bulk Partner the necessary information to email enrollment materials to such Bulk Partner’s customer base. If you have received a REMAX Canada PerksConnect email or invitation to become a Member or join the Program, the Bulk Partner may have enrolled you in this discount program and/or submitted your information to Augeo, but only after receiving authorization from you to do so. The Bulk Partner, not Augeo, is liable if the Bulk Partner failed to solicit and receive your consent. 11. Changes to Offers or Merchants

Offers made available through REMAX Canada PerksConnect may change from time to time. Augeo reserves the right in its sole discretion to change the offers and/or participating merchants at any time. In addition, merchants may elect to change offers from time to time. Augeo will make commercially reasonable efforts to make appropriate updates to the Site to reflect offer and/or merchant changes. If you become aware of a discontinued offer listed, please notify Augeo by sending an e-mail to REMAX Canada PerksConnect or contacting REMAX Canada PerksConnect Customer Service at the address(es), phone number(s), and/or email address(es) listed above. Augeo undertakes no obligation to provide a replacement or substitute offer for any offer discontinued.

12. Privacy
